A lei altera mais de 100 pontos da atual Consolida\u00e7\u00e3o das Leis do Trabalho (CLT), permitindo, dentre as mudan\u00e7as, que o acordado entre os patr\u00f5es e empregados prevale\u00e7a sobre a legisla\u00e7\u00e3o atual, al\u00e9m de altera\u00e7\u00f5es relevantes na vida das empresas e dos trabalhadores, como: a previs\u00e3o do trabalho intermitente; do home office; da possibilidade de redu\u00e7\u00e3o do intervalo para refei\u00e7\u00e3o; do fracionamento das f\u00e9rias; do fim das horas de trajeto (horas in itinere), etc..<\/p>\n\n\n\n<p id=\"viewer-cgg89\">As mudan\u00e7as devem entrar em vigor 120 dias ap\u00f3s a publica\u00e7\u00e3o da lei no Di\u00e1rio Oficial da Uni\u00e3o (14\/07\/2017), anotando que tamb\u00e9m j\u00e1 foi enviado ao congresso nacional, uma minuta de Medida Provis\u00f3ria, com os pontos pol\u00eamicos a serem objeto de negocia\u00e7\u00e3o c<\/p>\n\n\n\n<p id=\"viewer-4k272\">om os parlamentares, fruto de acordo ajustado para sua aprova\u00e7\u00e3o.<\/p>\n\n\n\n<p id=\"viewer-p83km\">Dentre os diversos pontos tratados na Reforma Trabalhista, vale destacar alguns de grande relev\u00e2ncia:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Restringe o conceito de grupo econ\u00f4mico, cujos membros tem responsabilidade solid\u00e1ria para pagamentos de verbas trabalhistas;<\/li><li>Reduz o poder do Judici\u00e1rio Trabalhista de criar obriga\u00e7\u00f5es n\u00e3o previstas em Lei \u2013 Ativismo Judicial;<\/li><li>Regulamenta o teletrabalho (home office), estabelecendo direitos e obriga\u00e7\u00f5es para as partes;<\/li><li>Estabelece que as normas coletivas firmadas com os sindicatos prevalecer\u00e3o sobre a lei, em determinados assuntos, priorizando o negociado sobre o legislado, proporcionando maior autonomia \u00e0s partes;<\/li><li>Traz novas diretrizes ao trabalho em tempo parcial, aumentando seu limite de horas e previs\u00e3o de horas extras;<\/li><li>Modifica regras relacionadas \u00e0s horas de trabalho, intervalos e f\u00e9rias;<\/li><li>O tempo gasto entre casa e empresa n\u00e3o conta mais como tempo de trabalho (hora in itinere);<\/li><li>Permite a livre estipula\u00e7\u00e3o de condi\u00e7\u00f5es de trabalho para determinados temas, aos empregados portadores de diploma de gradua\u00e7\u00e3o superior e que recebem mais de R$ 11.063 (teto limite atual de benef\u00edcio da previd\u00eancia), inclusive escolham a arbitragem como meio de resolu\u00e7\u00e3o de disputas com os patr\u00f5es;<\/li><li>Permite que empresas e empregados assinem acordos de transa\u00e7\u00e3o de direitos e submetam tal acordo ao judici\u00e1rio para homologa\u00e7\u00e3o;<\/li><li>Elimina a obrigatoriedade da contribui\u00e7\u00e3o sindical, permitindo aos empregados e empresas optarem ou n\u00e3o por contribuir, sem que isto afete a abrang\u00eancia, a todos empregados, das normas coletivas;<\/li><li>Estabelece regras e limites no valor das indeniza\u00e7\u00f5es por danos morais; e<\/li><li>Modifica quest\u00f5es processuais relevantes, limitando a justi\u00e7a gratuita e estabelecendo honor\u00e1rios advocat\u00edcios e multas para quem agir de m\u00e1-f\u00e9.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/static.wixstatic.com\/media\/6b349d5084fe4e1ab79c0d0522bdae5f.jpg\/v1\/fill\/w_360,h_284,al_c,q_90\/6b349d5084fe4e1ab79c0d0522bdae5f.webp\" alt=\"\"\/><\/figure>\n\n\n\n<p id=\"viewer-xkpnx\">Anotamos que a lista acima n\u00e3o \u00e9 exaustiva, tampouco visa detalhar as altera\u00e7\u00f5es.
