QU'EST-CE QUE CELA CHANGERA?"},"content":{"rendered":"<p id=\"viewer-l1olo\">Il a \u00e9t\u00e9 publi\u00e9 aujourd'hui au Journal officiel la loi 13467\/2017. Cette loi modifie plus de 100 points de Code du Travail br\u00e9silien (CLT \u2013 consolida\u00e7\u00e3o das leis do trabalho), ce qui permet notamment et sous certaines conditions de faire pr\u00e9valoir les accords collectifs\u00e0 par rapport \u00e0 la l\u00e9gislation en vigueur. De plus, cette loi a amen\u00e9 des changements importants dans la vie des entreprises et des travailleurs : la r\u00e9gl\u00e9mentation du travail intermittent; le bureau \u00e0 domicile; la possibilit\u00e9 de r\u00e9duire les pauses pour la repas; le fractionnement des vacances; la fin de l\u00b4in\u00e9tration au salaire des heures de trajet pour se rendre au travail etc.<\/p>\n\n\n\n<p id=\"viewer-cgg89\">Les changements devraient prendre effet 120 jours apr\u00e8s la publication de la loi au Journal officiel (14\/07\/2017), toutefois nous mettons en exergue qu'il a \u00e9t\u00e9 envoy\u00e9 au Congr\u00e8s National, un projet provisoire aff\u00e9rents aux sujets controvers\u00e9s pour n\u00e9gociation et post\u00e9rieur amendement de la loi (si n\u00e9cessaire)..<\/p>\n\n\n\n<p id=\"viewer-4k272\">om os parlamentares, fruto de acordo ajustado para sua aprova\u00e7\u00e3o.<\/p>\n\n\n\n<p id=\"viewer-p83km\">Parmi les diff\u00e9rentes questions trait\u00e9s dans la r\u00e9forme du travail, il convient de souligner quelques-uns d'une grande importance. Ainsi, la nouvelle loi :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Restreint le concept de groupe \u00e9conomique, dont les membres ont une responsabilit\u00e9 conjointe pour les paiements de montants d\u00fbs au travailleur<\/li><li>R\u00e9duit le pouvoir des tribunaux prud\u00b4homaux pour cr\u00e9er des obligations non pr\u00e9vues par la  Loi \u2013 \u00ab Activisme judiciaire \u00bb ;<\/li><li>R\u00e9glemente le t\u00e9l\u00e9travail (bureau \u00e0 domicile), \u00e9tablissant des droits et des obligations entre les parties ;<\/li><li>\u00c9tablit que les normes collectives n\u00e9goci\u00e9es avec les syndicats pr\u00e9vaudront sur la loi dans certaines mati\u00e8res, offrant une plus grande autonomie aux parties;<\/li><li>Apporte de nouvelles directrices pour travailler \u00e0 temps partiel, ce qui augmente le limite d'heures et les pr\u00e9visions des heures suppl\u00e9mentaires ;<\/li><li>Modifie les r\u00e8gles relatives aux heures de travail, les pauses et les cong\u00e9s ;<\/li><li>La dur\u00e9e du trajet domicile\/travail n\u00b4est plus consid\u00e9r\u00e9e comme heure travaill\u00e9e ;<\/li><li>Permet la libre stipulation des conditions de travail sur certains aspects d\u00e8s lorsque l\u00b4 employ\u00e9 est dipl\u00f4m\u00e9 poss\u00e9dant  une formation universitaire et que sa r\u00e9mun\u00e9raiton d\u00e9passe R$ 11.063,00 (limite actuelle de plafond de la S\u00e9curit\u00e9 Sociale), les parties pouvant notamment choisir l'arbitrage pour r\u00e9gler les diff\u00e9rends;<\/li><li>Permet aux entreprises et aux employ\u00e9s de signer des accords de transaction des droits et soumettre cet accord au judiciaire pour homologation;<\/li><li>Elimine les cotisations syndicales obligatoires, sans pour autant affecter l\u00b4application  des normes collectives a tous les employ\u00e9s;<\/li><li>D\u00e9finit les r\u00e8gles et les limites sur le montant de l'indemnit\u00e9 par dommage moral; et<\/li><li>Modifie des questions de proc\u00e9dure pertinentes, ce qui limite l'aide juridique gratuite et \u00e9tablit des honoraires d\u2019avocat et des amendes pour ceux qui agissent de mauvaise foi.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/static.wixstatic.com\/media\/6b349d5084fe4e1ab79c0d0522bdae5f.jpg\/v1\/fill\/w_360,h_284,al_c,q_90\/6b349d5084fe4e1ab79c0d0522bdae5f.webp\" alt=\"\"\/><\/figure>\n\n\n\n<p id=\"viewer-xkpnx\">Nous notons que la liste ci-dessus n'est pas exhaustive, et ne cherche pas \u00e0 d\u00e9tailler les changements.
