{"id":486,"date":"2022-05-12T16:17:00","date_gmt":"2022-05-12T19:17:00","guid":{"rendered":"https:\/\/www.gtlawyers.com.br\/site\/?p=486"},"modified":"2022-06-03T11:57:08","modified_gmt":"2022-06-03T14:57:08","slug":"principais-aspectos-da-medida-provisoria-927-2020","status":"publish","type":"post","link":"https:\/\/www.gtlawyers.com.br\/fr\/noticia\/principais-aspectos-da-medida-provisoria-927-2020\/","title":{"rendered":"Principaux aspects de la Mesure Provisoire 927\/2020"},"content":{"rendered":"<p id=\"viewer-zo8ra\">Le D\u00e9partement de Droit Social de GTLawyers a pr\u00e9par\u00e9 un r\u00e9sum\u00e9 pr\u00e9sentant les principales caract\u00e9ristiques de la mesure provisoire n\u00ba 927\/2020, y compris la r\u00e9vocation de l'article 18 qui traitait de la suspension du contrat de travail, aux termes de la mesure provisoire n\u00ba 928\/2020 :<\/p>\n\n\n\n<p id=\"viewer-as5uf\">La Mesure Provisoire apporte des mesures que les employeurs peuvent prendre dans le contexte de crise r\u00e9sultant de l'\u00e9tat d\u2019urgence (\u00ab Estado de Calamidade P\u00fablica \u00bb) reconnu par le Congr\u00e8s National et de situation d'urgence m\u00e9dicale r\u00e9sultant du Covid-19.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Les r\u00e8gles de la MP sont temporaires et valables uniquement jusqu'au 31\/12\/2020.<\/li><li>L'objectif de la MP est de pr\u00e9voir des mesures de travail visant \u00e0 pr\u00e9server l'emploi et les revenus. Il est clair que la priorit\u00e9 est de pr\u00e9server l'emploi.<\/li><li>\u00c0 des fins de droit du travail, il est reconnu que toute cette situation constitue un cas de force majeure. <strong>T\u00e9l\u00e9travail<\/strong><\/li><li>Le passage au t\u00e9l\u00e9travail, au travail \u00e0 distance ou \u00e0 un autre type de r\u00e9gime de travail \u00e0 distance, et son arr\u00eat, ne d\u00e9pendent pas d'une convention individuelle ou collective.<\/li><li>Le changement de r\u00e9gime doit \u00eatre communiqu\u00e9 au salari\u00e9 au moins 48 heures \u00e0 l'avance.<\/li><li>La MP assimile le t\u00e9l\u00e9travail \u00e0 toutes les formes de travail \u00e0 distance.<\/li><li>L'employeur et l'employ\u00e9 doivent d\u00e9terminer qui sera responsable des d\u00e9penses li\u00e9es au travail et si les d\u00e9penses seront rembours\u00e9es par l'employ\u00e9. Nous recommandons aux employeurs d'\u00e9tablir ces r\u00e8gles afin d'\u00e9viter le risque que la jurisprudence interpr\u00e8te qu'en l'absence d'accord expr\u00e8s, les d\u00e9penses doivent \u00eatre support\u00e9es par l'employeur, en tout ou en partie.<\/li><li>Il est \u00e9tabli que, si le salari\u00e9 ne dispose pas d'\u00e9quipements et d'infrastructures pour le t\u00e9l\u00e9travail et si l'employeur ne les fournit pas, il appartiendra \u00e0 l'employeur de r\u00e9mun\u00e9rer le salari\u00e9 pour la dur\u00e9e normale de travail.<\/li><li>L'utilisation d'applications et de programmes de communication en dehors des heures normales de travail ne constitue pas du temps de mise \u00e0 disposition.<\/li><li>Ce r\u00e9gime s'applique \u00e9galement aux stagiaires et aux apprentis, bien que rien ne soit dit sur la mani\u00e8re de traiter les questions li\u00e9es \u00e0 la pratique professionnelle.<\/li><\/ul>\n\n\n\n<p id=\"viewer-1hc6t\"><strong>Anticipation des jours de cong\u00e9s pay\u00e9s<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La communication peut \u00eatre effectu\u00e9e au moins 48 heures \u00e0 l'avance.<\/li><li>Des jours de cong\u00e9s peuvent \u00eatre accord\u00e9s m\u00eame si la p\u00e9riode d'acquisition de ces jours n'est pas encore \u00e9coul\u00e9e. Par accord \u00e9crit, de futures p\u00e9riodes de cong\u00e9s pay\u00e9s peuvent \u00e9galement \u00eatre pr\u00e9vues.<\/li><li>La prime des 1\/3 de cong\u00e9s pay\u00e9s peut \u00eatre vers\u00e9e jusqu'\u00e0 la date de paiement du 13\u00e8me mois. Cette mesure repr\u00e9sente donc un report du terme de paiement. La r\u00e9mun\u00e9ration normale des cong\u00e9s pay\u00e9s peut \u00eatre vers\u00e9e jusqu'au 5\u00e8me jour ouvrable du mois suivant le d\u00e9but de la prise desdits cong\u00e9s.<\/li><li>Le paiement de l\u2019indemnit\u00e9 financi\u00e8re d\u00e9pend de l'accord de l'employeur.<\/li><li>Les travailleurs appartenant au groupe \u00e0 risque seront prioris\u00e9s pour profiter des cong\u00e9s pay\u00e9s individuels ou collectifs.<\/li><\/ul>\n\n\n\n<p id=\"viewer-b84op\"><strong>Cong\u00e9s collectifs<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La communication peut \u00eatre effectu\u00e9e au moins 48 heures \u00e0 l'avance.<\/li><li>Les limites de dur\u00e9e minimale et maximale pr\u00e9vues dans la loi sur le travail (\u00ab CLT \u00bb) ne s'appliquent pas. Nous comprenons que les m\u00eames directives pour les cong\u00e9s individuels doivent \u00eatre suivies.<\/li><li>Dispensada a comunica\u00e7\u00e3o para Minist\u00e9rio da Economia e sindicato profissional.<\/li><\/ul>\n\n\n\n<p id=\"viewer-5jvbt\"><strong>Anticipation des jours f\u00e9ri\u00e9s<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Des jours f\u00e9ri\u00e9s non religieux peuvent \u00eatre anticip\u00e9s et les employ\u00e9s doivent \u00eatre inform\u00e9s dans les 48 heures, avec indication expresse des jours f\u00e9ri\u00e9s qui seront utilis\u00e9s. Ces jours f\u00e9ri\u00e9s peuvent \u00eatre compens\u00e9s dans la banque d'heures.<\/li><li>Les jours f\u00e9ri\u00e9s religieux ne peuvent \u00eatre utilis\u00e9s \u00e0 l'avance qu'avec l'accord \u00e9crit de l'employ\u00e9.<\/li><\/ul>\n\n\n\n<p id=\"viewer-2lce4\"><strong>Banque d'heures<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La p\u00e9riode d'indemnisation a \u00e9t\u00e9 \u00e9tendue jusqu'\u00e0 18 mois, \u00e0 compter de la date de cl\u00f4ture de l'\u00e9tat d\u2019urgence.<\/li><li>L'indemnisation ne d\u00e9pend pas d'une convention collective ou individuelle du travail.<\/li><\/ul>\n\n\n\n<p id=\"viewer-1aj9i\"><strong>S\u00e9curit\u00e9 et sant\u00e9 au travail<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Les examens m\u00e9dicaux professionnels sont prolong\u00e9s pour la dur\u00e9e de la p\u00e9riode d\u2019\u00e9tat d\u2019urgence, \u00e0 l'exception des examens de sortie du travail, jusqu'\u00e0 60 jours apr\u00e8s la fin de l\u2019\u00e9tat d\u2019urgence. Cependant, l'examen de sortie du travail peut \u00eatre annul\u00e9 si le dernier examen professionnel a \u00e9t\u00e9 effectu\u00e9 il y a moins de 180 jours.<\/li><li>La formation p\u00e9riodique pr\u00e9vue par les normes et l\u00e9gislations r\u00e9glementaires est suspendue et peut \u00eatre dispens\u00e9e dans les 90 jours apr\u00e8s la fin de l'\u00e9tat d\u2019urgence.<\/li><li>La formation \u00e0 distance est autoris\u00e9e.<\/li><li>La CIPA (Commission Interne de Pr\u00e9vention des Accidents) est maintenue jusqu'\u00e0 la fin de l\u2019\u00e9tat d\u2019urgence. Les processus \u00e9lectoraux peuvent \u00eatre suspendus.<\/li><\/ul>\n\n\n\n<p id=\"viewer-yzacx\"><strong>Remarques G\u00e9n\u00e9rales :<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>L\u2019Art. 18 de la MP n\u00ba 927\/2020, a \u00e9t\u00e9 r\u00e9voqu\u00e9, aux termes de la MP n\u00ba 928\/2020.<\/li><li>Report du paiement du FGTS li\u00e9 aux comp\u00e9tences du mois de mars, avril et mai 2020 et possibilit\u00e9 de paiement dans un d\u00e9lai maximum de 6 mois, sans p\u00e9nalit\u00e9 ni frais, \u00e0 partir de juillet 2020. Un traitement sp\u00e9cifique est pr\u00e9vu en cas de rupture du contrat.<\/li><li>La p\u00e9riode des Certificats de R\u00e9gularit\u00e9 d\u00e9livr\u00e9s avant l'entr\u00e9e en vigueur de cette MP est prolong\u00e9e.<\/li><li>Le d\u00e9lai de pr\u00e9sentation des recours en cas d'infraction est suspendu pour 180 jours \u00e0 compter de l\u2019entr\u00e9e en vigueur de la MP.<\/li><li>Les cas de contamination par le Covid-19 ne seront pas consid\u00e9r\u00e9s comme des accidents du travail, sauf avec preuve du lien de causalit\u00e9.<\/li><li>Les accords et conventions collectifs expir\u00e9s ou en vue d\u2019\u00eatre expir\u00e9s, dans les 180 jours suivant l'entr\u00e9e en vigueur de la MP, peuvent \u00eatre prolong\u00e9e de 90 jours apr\u00e8s la fin du terme initial, \u00e0 la discr\u00e9tion de l'employeur.<\/li><li>Pendant un d\u00e9lai de 180 jours \u00e0 partir de l\u2019entr\u00e9e en vigueur de la MP, les auditeurs en droit du travail agiront \u00e0 titre indicatif, sauf en cas d'irr\u00e9gularit\u00e9s r\u00e9sultant d'un d\u00e9faut d'enregistrement, de plaintes, de situations de risque grave et imminent, d'accident mortel ou de travail dans des conditions similaires \u00e0 celles de l\u2019esclavage ou de travail des enfants.<\/li><li>Les mesures prises par les employeurs au cours des 30 derniers jours qui ne contreviennent pas aux dispositions de la MP sont express\u00e9ment valables.<\/li><li>L\u2019accord individuel entre l'employeur et l'employ\u00e9 pr\u00e9vaudra sur les autres actes normatifs juridiques et commerciaux, pour autant que les limites fix\u00e9es par la Constitution f\u00e9d\u00e9rale soient respect\u00e9es.<\/li><\/ul>\n\n\n\n<p id=\"viewer-yqux5\"><strong>CONTACTS<\/strong><\/p>\n\n\n\n<p
